Terms of Use
Last updated: October 21, 2026
In short: You own your data. ContractorCost Pro helps you estimate and run jobs, but you are responsible for checking every number before you bid or build. Subscriptions are billed through our reseller, Paddle. These terms are governed by Missouri law.
1. Agreement
These Terms of Use ("Terms") are an agreement between Victor Studio LLC, a Missouri limited liability company ("we", "us"), and the company or person that signs up for ContractorCost Pro (the "Customer", "you"). They cover the ContractorCost Pro website, app and related services (the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you accept for a company, you confirm that you have authority to bind it.
2. Accounts and users
- You must be at least 18 and give accurate account information.
- The Customer's owner and admins decide who gets access and what each person can see and do. You are responsible for your users and everything done under your account.
- Keep passwords private and tell us right away at contractorcostpro@gmail.com if you suspect unauthorized access.
3. Subscriptions, trials and billing
- Paddle is our reseller. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, and its own buyer terms apply to your purchase.
- Plans and prices are shown on our pricing page at the time you subscribe. Applicable taxes are added at checkout.
- Renewal. Subscriptions renew automatically for the same period (monthly or yearly) until cancelled. You can cancel at any time; cancellation takes effect at the end of the current paid period.
- Free trials last the period stated at sign-up. If you don't cancel before the trial ends, your paid subscription begins.
- Refunds are covered by our Refund Policy.
- Price changes take effect at your next renewal, and we will give you at least 30 days' notice.
- Failed payments. If a payment fails and isn't fixed within a grace period, we may limit the account to read-only until it's paid. Your data is not deleted because of a failed payment while you can still bring the account current.
- Usage limits. Plans may include limits, such as the number of users or monthly AI requests. If you reach a limit, the related feature may pause until the next period or until you upgrade.
4. Your data
- You own the data you and your users put into the Service ("Customer Data"). You give us permission to host, copy, process and display Customer Data only as needed to provide, secure and support the Service for you.
- You are responsible for the accuracy of Customer Data and for having the right to put it in the Service, including information about your clients, vendors and employees. If you turn on time clock location, you are responsible for any notice or consent your state requires.
- You can export Customer Data at any time while your account is open, and for 30 days after it ends (section 11).
- We handle personal information as described in our Privacy Policy.
5. Acceptable use
You agree not to:
- break the law, or infringe or misuse anyone's rights or information;
- try to get into another company's data, get around permissions, limits or security, or probe, scan or test the Service for weaknesses without our written permission;
- overload or disrupt the Service, or use bots or scripts against it beyond normal use;
- copy, resell, or reverse engineer the Service, or use it to build a competing product;
- upload malware, or content you don't have the right to share.
We may suspend access that threatens the Service, other customers or the law. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
6. Estimates, calculations and professional judgment
ContractorCost Pro is a tool to help you prepare estimates and manage work. It is not a substitute for your professional judgment, and it does not give legal, accounting, tax, insurance or engineering advice. Material prices, production rates, labor hours, takeoff quantities, overhead and burden figures, contract templates and other suggestions are starting points that may be incomplete or wrong.
You are responsible for verifying every quantity, price, calculation and document before you submit a bid, sign a contract, order materials or bill a client; for complying with laws, codes, licensing and permit requirements; and for all business decisions you make using the Service. Contract templates are generic and may not meet your state's requirements; have an attorney review them before use.
7. AI features
Some features, such as AI Import, use artificial intelligence provided by third parties. AI output can be wrong, incomplete or inconsistent. Check it against your drawings and records before relying on it. Content you submit to an AI feature is sent to that provider as described in our Privacy Policy. AI features are optional, may have usage limits, and may change or be withdrawn.
8. Third-party services
The Service can connect to services we don't control, such as QuickBooks Online, map providers and payment processing. Your use of them is governed by their own terms, and you need your own account where one is required. We aren't responsible for third-party services or for changes they make that affect the connection. QuickBooks is a trademark of Intuit Inc.; ContractorCost Pro is not affiliated with or endorsed by Intuit.
9. Changes and availability
We work to keep the Service available and improving, and we may add, change or remove features. Planned maintenance and events outside our control may cause interruptions. If we remove a major feature you rely on, you may cancel and receive a prorated refund of any prepaid amount for the remaining period. We may update these Terms; if a change is significant, we will give account owners at least 30 days' notice. Continuing to use the Service after a change takes effect means you accept it.
10. Our property
The Service, including its software, design, text and the ContractorCost Pro name and logo, belongs to Victor Studio LLC and is protected by law. We give you a limited, non-exclusive, non-transferable right to use the Service for your internal business during your subscription. If you send us suggestions, we may use them without obligation to you.
11. Ending the agreement
- You may cancel at any time (section 3).
- We may end or suspend your account if you materially break these Terms and don't fix the problem within 10 days of notice, immediately for serious breaches such as security abuse or illegal use, or with 60 days' notice if we stop offering the Service.
- After your account ends, you have 30 days to export Customer Data. After that we delete it, as described in our Privacy Policy.
- Sections 4, 6, 7, 10, 12, 13, 14 and 15 continue after the agreement ends.
12. Disclaimer of warranties
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the fullest extent the law allows, Victor Studio LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and does not warrant that the Service will be uninterrupted, error-free, or that any estimate, calculation or output will be accurate or profitable.
13. Limitation of liability
To the fullest extent the law allows: (a) Victor Studio LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, bids, business or data, even if advised they were possible; and (b) Victor Studio LLC's total liability for all claims relating to the Service or these Terms will not exceed the greater of the amounts you paid for the Service in the 12 months before the claim arose, or one hundred U.S. dollars ($100).
Some places don't allow certain of these limits, so they apply to you only as far as your law permits.
14. Indemnification
You agree to defend and hold harmless Victor Studio LLC and its owners from third-party claims, and the resulting losses and reasonable legal fees, arising from Customer Data, your use of the Service in breach of these Terms or the law, or estimates, bids, contracts and work you produce using the Service.
15. Governing law and disputes
These Terms are governed by the laws of the State of Missouri and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, each side agrees to try to resolve the dispute informally for 30 days after written notice. Any lawsuit must be brought in the state or federal courts located in Missouri, and both sides consent to their jurisdiction.
16. General
These Terms, the Privacy Policy, the Refund Policy and your order are the whole agreement about the Service. If a provision is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger or sale of our business. Neither side is responsible for delays caused by events beyond its reasonable control. Notices to us go to the contact below; notices to you go to the account owner's email.
